Data gathered through market research

Boxclever Marketing Intelligence Limited (“Boxclever”, or “we” or “us”) are committed to protecting and respecting your privacy. Our Privacy Policy describes how we capture and use the personal data that we gather from respondents who may complete a market research survey or focus group which we are organising on behalf of a client. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

In line with European Data Protection legislation (GDPR), in some situations, Boxclever will act as Data Controller in relation to all personal data we collect from you (e.g. the responses you provide as part of an online survey).

In some instances, our clients will ask us to conduct market research on their behalf as a legitimate business interest (LBI). In this situation, the client will be the data controller and Boxclever will act as the Data Processor. This will be reflecting in the Privacy Policy of this clients. If you are asked to participate in research under these circumstances, it will be because you are a current customer of this client and their Privacy Policy will explain more detail about what this means.

We also act as a Data Processor for the data that our clients supply to us to enable us to contact you to participate in a market research survey or focus group (this data includes your contact details, like your name, email address or telephone number.

We will only process the data supplied by a client in accordance with our client’s instructions and for the purposes set out in the relevant contract between us and our client, such as our Proposal document, Project Confirmation and Services Agreement.

Information we may be given about you

In order for Boxclever to setup and run market research on behalf of a client, we may be given the following data about you. Clients normally given us the data of their current customers.

In order to contact you to request your participation in market research, we are on occasion provided with a list of customers by our client. This includes information that you provide to that client when you purchase from their websites or stores, subscribe to their services (including requesting information), register for or attend one of their events or training courses, engage in online chat with them or participate in forums or ask for support on their website. You will have been asked to confirm that you are happy to participate in future market research activity at this point.

If you do not believe you have given your permission to take part in research, please email privacy@boxcleverconsulting.com, stating that you do not recall having given permission.

Information we are given by a client about their customers may include your name, address, postcode, telephone number, email address and any other information you have provided to the client (for example, your age or gender)

Information that you give us

You may give us information about yourself, your attitudes and behaviours by answering questions via an online survey.

The information you give us may include your name, title, address, email address, phone number, job, ethnicity, income, and your views and attitudes towards buying a range of products and services.

The information that you give to us via a survey or market research interview/focus group is compared to the information provided by lots of other consumers like yourself, and Boxclever carry out an analysis of this data to produce a report to our client. This report looks at trends in the data and a consensus of opinion; as such, it is analysed anonymously, at an aggregate rather than individual customer level. This means that, in the data we analyse, we do not see or report on individual customer behaviour or views, or have access to or are able to provide any details of the identity of specific customers who have taken part, to our clients.

Information that we/our hosting partners may collect about you

When you complete a survey, we use a partner company to host the survey, and this partner also acts as a data processor. This partner company may automatically collect information about your visit such as the webpages or sections you viewed, questions you completed, length of visits to certain pages, and the times and dates of these actions. These partner companies may also collect data from the device and application that you use to access the survey, including your IP address (from which it may be possible to infer your geographic location), and browser type. If you arrive at the survey website from an external source (such as a link on another website or in an email) the partner company may record information about that source.

If you have any questions or concerns about the way that our hosting partners handle information they may collect about you, please contact privacy@boxcleverconsulting.com and we will connect you with the relevant partner who is the data processor for the survey you have completed.

Information that we receive from other sources

We may receive information about you from third parties with whom we work including our focus group recruitment partners, analytics providers, and the group companies of our clients.

How We Use the Information

We use the information held about you in the following ways:

Please be aware that our clients control the surveys and what happens to the survey data. We will not identify participants in a survey to our clients. We will not make the survey responses public. We will not use your personal details to contact you for any purpose outside of operating the survey.

Disclosure or Sharing of Your Information

We will only disclose your personal information in the circumstances described below.

In relation to survey data, we will not provide any information submitted in response to a survey, nor respondent contact details, to third parties other than our client, unless we are required to do so by law.

Updating your Information

If you wish to update, amend or request deletion of your personal information or data you may do so by contacting us at privacy@boxcleverconsulting.com. We will respond to your request within 30 days.

Your Rights as a Data Subject

On your request we will provide you with information about whether we hold any of your personal information. To request this information please contact us at privacy@boxcleverconsulting.com. You may update, amend or request deletion of your information.

If you are a respondent to a survey and wish to access, correct, amend inaccuracies in or delete personal data stored or processed by us on behalf of one of our clients, or exercise the rights described below, you should contact us at privacy@boxcleverconsulting.com. Where needed, we will provide assistance to help you also contact our clients to deal with your request.

If within the EEA, you also have the right to exercise additional rights available to you, including:

Right of Erasure: in certain circumstances you have the right to erasure of personal data held about you, although this may be qualified where e.g. it is necessary for that data to be retained for record keeping purposes or compliance with our obligations.

Right to Object: you have the right to request that we stop processing your personal data for marketing purposes, and may have the right to object to our processing of your personal data for other purposes.

Right of Restriction: you may have to right to request that we restrict the processing of your personal data (e.g. where you believe that the personal data we hold about you is inaccurate or unlawfully held).

Right to Data Portability: you may have the right to be provided with your personal data in a structured, machine readable and commonly used format and to request that we transfer the personal information provided by you to another data controller.

You also have the right to complain to a data protection authority about our collection and use of your personal data. In the UK, this is the Information Commissioner’s Office ico.org.uk.

Data Retention

We will retain your information for as long as our market research project is active on behalf of our client (usually 6-20 weeks) or as needed to provide the contracted services to our client or otherwise fulfil the purposes described in this Privacy Policy. If you wish to request that we no longer use your information to this end please contact us at privacy@boxcleverconsulting.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
